 Thank you for taking the time to read Your Endless Love Terms & Conditions

This document is a binding contract between you and Your Endless Love company (Terms and Conditions) and it is important you know your rights before you continue to use our application (“Your Endless Love”). Please use your earliest convenience to read the Terms before you use the App, because as soon as you access, browse, or use the App, you are legally bound by the Terms and Conditions below. Please read our Terms carefully and abide by the rules and regulations that constitutes with our standards before you start using the App(“Your Endless Love“).
NOTE: Please take in consideration when you subscribe to our service using one of the following plans:

  • Standard
  • Pro
  • Premium

Your subscription will automatically be renewed for each period of the same duration based on the Terms of Your Endless Love in Subscription Agreeement section below and the current expense or fee will be applied until you cancel your subscription in agreement of Subscription Agreement section below.

Rules and Regulations

The privacy policy applies to websites and apps under the To even be permitted to use the App, you must be registered with an Your Endless Love account.

The following rules apply for creating accounts:

  • You must be 18 years old or be legally of age based on your home country to be legally be allowed to use our services according to the laws of your home country.

  • Be legally permitted to use Your Endless Love App in your home country

Your account must be created by you and not on behalf of another person. You are able to create an account in the following ways:

  • Apple Login
  • Google
  • Facebook

When using any of the aforementioned social media accounts, you are giving permission or authorising us to display and use certain information from your account(Name, photos, relationship status, location and information about Facebook friends). You can find more information on how we use your information when you are signed on or have your account created by reading our Privacy Policy We do not allow you to use another person's account and DO NOT make it permissible to share your account. If you decide to no longer use our serivices and have your account permanently deleted(App Profile deleted, photos deleted, bio, age, preferences, email address). When you delete your account, your profile and any in app purchases you bought such as rose likes and boosts will be permanently deleted and no refunds are given if you decide to remove your account. Please consider carefully when you delete your account if you made any in-app purchases. After you delete your account, your profile will be treated in accordance with our Privacy Policy. You can recreate your account at any given time as long as you abide and conform to our Moderation Control Policy(No Explicit Content) and we monitor abusive language to ensure our customer's safety. If you breach the Privacy Policy, and Terms and Conditions, we reserve the right to terminate, block, or suspend your account indefinitely at our discretion and we may restrict access to the Your Endless Love App. We enforce our Terms seriously by blocking specific IP addresses that have direct access to the Your Endless Love App or website. We use automated tools to moderate content to ensure safety. In summary, we reserve the right to terminate, ban, sustpend your account without notice based on the following:

  1. Violating these terms
  2. Misconduct on the App
  3. Misconduct with other users on the app including "offline" behavior(Rudeness, Disrespectful comments, abusive language, or threats) that harms our user's safety
  4. Any Affiliate apps in the future deem your conduct to be abusive or harmful

We DO NOT condone any violence whether its online or offline(in person). Please resepect the person you are communicating and interacting with to ensure a safe and enjoyable experience. PLEASE READ CAREFULLY If your Account is terminated or suspended, you agree you will not receive a refund for any paid service or features you have already been charged for. You may not access, tamper with, or use non-public areas of the App or our systems. Certain portions of the App may not be accessible if you have not registered for an Account.

Moderation Control Policy

The following types of content has three below:

  • Profile content uploaded and provided(“Your Endless Love Content“)
  • Member Content(Other User's Content)
  • Content provided by the Your Endless Love company (“Your Endless Love Content“) that includes without limitation, database(s) and/or software(“Our Content”).
Obscene Language

NOT ACCEPTED OR TOLERATED: Inflammatory remarks that are profanely offessenive is likely to harrase, disturb, alert, irriate any other person(for instance and without limitation, language that is deemed to be discriminatory towards an individual's race, colour, ethnicity, national origin, religion, disability, sexual orientation, gender expression, gender identity or physical looks).

Inappropriate Language

NOT ACCEPTED OR TOLERATED: Inappropriate content is not tolerated and any content that is deemed obscene, pornographic, violent or otherwise may offend human dignity(including for instance and without limitation, language that is deemed to be discriminatory towards an individual's race, colour, ethnicity, national origin, religion, disability, sexual orientation, gender expression, gender identity or physical looks). Photos and language that offends people's dignity or self-worth will not be accepted. Sexual Suggestive or revealing clothing in your photos is NOT appropriate and will be flagged to be deleted. Depending on the severity of the photo, your account will be deleted or you would have to re-create your account again. Please only upload photos that are modest and appropriate as if you went to a public place(restauraunts, conferences, job meetings, church) that signify human dignity and respect.

Threatenining\Discriminatory

NOT ACCEPTED OR TOLERATED: Any content uploaded by you or other members registered with an account with us has language or photos with abusive, threatening, discriminatory that raises or develops racist cruel behaviour will be banned. No hatred, sexism or bigotry(including for instance and without limitation, lanaguage that threatens or insults a person's race, colour, ethnicity, nationality, religous views, disablity, sexual orientation, gender expression, gender identity or physical appearance).

Illegal Activity

NOT ACCEPTED OR TOLERATED: Promotes any illegal actions, which includes without limitation, terrorism or racism that places an indiviual under submission by harming them physically or verbally. Any criminial offences towards a person is NOT accepted.

Defamatory\Libellous

NOT ACCEPTED OR TOLERATED: Defamatory or libellous behaviour is not tolerated.

Soliciting

NOT ACCEPTED OR TOLERATED: Soliciting which relates to commercial activities(including, without limitation, sales, competitions, tournaments, advertising, links to ther websites or apps being promoted, premium line telephone numbers.

Junk Mail\Spam

NOT ACCEPTED OR TOLERATED: Junk Mail\Spam is not tolerated sent by other persons to our email addresses(support contact "Our Support Email Contact") that could potentially harm our security.

Spyware\Adware\Viruses

NOT ACCEPTED OR TOLERATED: The transmission of spyware, adware, viruses, or any file that can cause corruption including worm programmes that can disrupt any software, hardware, telecommunications, networks, servers, or other equipment. Additionally, Trojan horses or code that could malicously that can make a system malfunction or be completely destroyed, inteference, unlawfully or immorally intercept or expropriate any data or personal information whether from Your Endless Love or any other entity or individual.

Third Party Infringement

NOT ACCEPTED OR TOLERATED: Third party infringement rights are violated (including without limitation, intellectual property and privacy rights)

Consent

NOT ACCEPTED OR TOLERATED: Shows another person which was created or distributed without that person’s consent

Minors

NOT ACCEPTED OR TOLERATED: Harmful to minors NOT to be condoned or exscused.

Impersonation

NOT ACCEPTED OR TOLERATED: Impersonation of any person, including wrongfully, unlawfully, negatively, or falsely stating your name.

Your Endless Love company operates a zero-tolerance policy for this kind of content.

Your Content

When you signup or create an account with Your Endless Love company, you agree that "Your Content"(including photos, biography, preferences, and other information you entered about yourself) must adhere or comply based on our guidlines found at https://www.yourendlessluv/guidelines, which gets updated perodically. You are responsible for your own content and liable for your "Your Content" and will indemify, defend, release, and hold us harmless from any claims made in connection with "Your Content". PLEASE READ CAREFULLY: Do not post something on "Your Endless Love" if it may deem embarrasement, destroy your reputation, or that is not aligned with core values of your profession. As you aware, this is a dating app, so please post photos and profiles based on good human dignity and it is deemed worthy of the upmost respect.
STRONGLY NOTED WITH GOOD MEASURE: Do not display any personal contact or banking information on your individual profile page or account whether in relation to you or any other individual(Example: home address, telephone number, postcodes, URLs, credit/debit card, cheque numbers or other banking details). You are taking your own risk if you decide to expose your personal information on your profile page or via chat in text messages (on the app, another communication tool, or offline), so please wise in your decisions because you are responsible for giving out your own information. Not everyone can be trusted of whom you meet, so please use your own discernment and awareness to take all necessary precautions that can harm you financialy or anything that can invade your privacy. Do not disclose details about yourself until you are certain with upmost validation; take caution by keeping your personal information private to an individual or third parties online as you would under any other circumstances. We are not obligated to keep your content.
In order to prevent uncosented use of your content by other members or third parties outside of Your Endless Love, you authorise us to act on your behalf with respect to such infringing and/or unauthorised uses. This expressly includes the authority, but not the obligation, for us to send takedown notices (including, without limitation, pursuant to 17 U.S.C. § 512(c)(3) (i.e., DMCA Takedown Notices)) on your behalf if Your Content is taken and used by third parties outside of Your Endless Love.

Member Content

Other members of Your Endless Love will also share content via the App("Your Endless Love App"). The content of the member belongs to the person who posted it and the content is stored on our servers and dispalyed via the App at the direction of the user providing the Member content. NOTE: You should not violate any rights of another member's content by use of misappropriation or public use without consent. You must adhere or comply to other Your Endless Love users' personal information to the extent that your use of it matches Your Endless Love's purpose of allowing people to be connected with one another.
You are not permitted to use other users' information for commercial purposes, to spam, to harass, stalk or to make unlawful threats. We reserve the right to ban or terminate your account indefintely if you misuse or misappropriate other users' information. Member Content is subject to the terms and conditions of Sections 512(c) and/or 512(d) of the Digital Millennium Copyright Act 1998. If you have a complaint about Member Content, please see the Digital Millennium Copyright Act section below for more information.

In order to provide the service for making connections with other people, we need information from you, which are basic details from the profile you create in the Your Endless Love app. Your profile includes your name, age, gender, photos, biography, and email address. Your email address is used to verify your account and we may send marketing promotional offers. You can opt out of receiving emails from Your Endless Love by logging into the app and go to Settings.

Data you provide to us

The content that is not posted by other members or by you belongs to Your Endless Loves(includes without limitation logos, graphics, images, design, sounds, artwork, and other intellectual property appearing on Your Endless Love) belongs to Your Endless Love company. The property appearing on Your Endless Love, as well as the Your Endless Love software and database(s), are owned, controlled or licensed by us and are protected by copyright, trademark, data, database rights and/or other intellectual property law rights. All right, title, and interest of our content belongs and owned by us at all times. We DO NOT grant you or any other member non-exclusive, limited, personal, non-transferable, revocable, license, to accesss our content, without the right to sublicens, under the following conditions:

  1. You shall not use, sell, modify, or distribute "Your Endless Love" content
  2. You shall not create derivative works from "Your Endless Love", our content, to scape, disable, decompile, analyse or in any way commercially exploit information from our website or App in any malicous way that threatens the intellectual property and product "Your Endless Love"
  3. You shall use our content lawfully only

We reserve all rights.

No obligation to Pre-Screen Content.

Due to the fact Your Endless Love company is an online community service, we do not prescreen individuals\members before signing up on the App and therefore don't assume any obligation to pre-screen any of your content or other member's content. Nevertheless, we may review your profile or other member's profile to ensure you are adhering to our policies. We reserve the right to review, pre-screen, refuse, and/or remove any member's content and your content, which includes content text messages or communication exchanges between you and your match via the app(Your Endless Love).

  • Comply with all applicable laws, including without limitation, privacy laws, intellectuall property laws, anti-span laws, equal opportunity laws and regulatory requirements;
  • Use your real name and real age in creating your "Your Endless Love";
  • Use the services in a professional manner;

  • Once the safety retention window elapses, we delete your data and only keep limited information for specified purposes, as laid out below:

    • You agree will not to:


      1. Act in an unlawful or unprofessional manner including being dishonest, abusive or discriminatory;

      2. misrepresent your identity, age, your current or previous job positions, credentials, qualifications, or affiliations with a person or entitiy;

      3. disclose information that you do not have the consent to disclose;

      4. stalk or harass any other user\member of the App;

      5. create or operate a pyramid scheme, fraudlent activity, or any other malicous practices, or;

      6. develop, support, or use software, devices, scripts, robots, other types of mobile code or any other means or processes(including crawlers, browser plugins and add-on other technology), to scrape or otherwise exfilitrate from Your Endless love or its services, or otherwise copy profiles and other data from the services.

    Misbehavior or misconduct is not tolerated in the Your Endless Love commmunity. You can report abusive or complain about user's\members "Your Endless love Content" by contacting us, outlining the abuse and/or complaint. You can also report a user directly from a profile or in chat by tapping or clicking on the Block icon or swiping the profile in the messages tab in the App(Your Endless Love App). We reserver the right to investigate any possible violation of these Terms, any Your Endless Love user's rights, or any third party or otherwise unauthorised user's content submitted to the App. We do not control user's physical behavior or words stated verbally, so you are solely responsible for your interactions with other users of the App.

    YOU AGREE AND UNDERSTAND THAT YOUR ENDLESS LOVE DOES NOT CURRENTLY CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS USERS. YOUR ENNDLESS LOVE ALSO DOES NOT MAKE ANY INVESTIGATIONS INTO MEMBERS BACKGROUND PROFILES OF USERS SIGNED UP ON THE APP OR MAKE THE EFFORT TO VALIDATE THE STATEMENTS OF OUR USERS. YOUR ENDLESS LOVE RESERVES THE RIGHT TO CONDUCT ANY CRIMINAL BACKGROUND CHECK TO ENSURE THE SAFETY OF OUR USERS FOR ANY SUSPECTED CRIMINAL ACTIVITIES OF YOU OR ANY OTHER MEMBER ON THE APP.

    By signing up or creating an account with Your Endless Love, you agree to, and hereby do, release Your Endless Love company and its successors from any claims, demands, losses, damages, rights, and actions of any kind, including personal injuries, death and property damage, that either directly or indirectly arises from communications or interactions with or conducton of other users of the App. The release does not apply to any claims, demands, or any losses, damages, rights and actions of any kind, including personal injuries, death, or property damage for any unconscionable commercial practice by Your Endless Love company or for such party's fraud, deception, false, promise, misprepresentation or concealment, suppression, or ommission of any matertial in connection with the App.
    Scraping or misrepresentation of the app is strictly prohibited.

    Privacy

    You can read more information about Your Endless Love privacy policy informatio on how we collect, use your data by reading the Privacy Policy page. By using Your Endless Love, you acknowledge that we are allowed to use your data in agreement with our Privacy Policy.

    Payments

    Generally stating, perodically, Your Endless Love will generally offer products and services for purchase, which are in "app purchases" in the App Store, Google Play, or other type of payement forms that are ONLY authorised by Your Endless Love. You may make a purchase in the following method (a) paying with your credit card, debit card, or PayPal account, which will be processed by a third party platform such as Apple App Store and Google Play Store. Alternatively, you make make a purchase through a Third Party Store that is ONLY authorised by Your Endless Love company. If payment is not received by us from your selected Payment Method, you agree to pay all dues owed demanded by us.

    Auto Renewal and Subscriptions

    Your Endless Love may offer some services as automatically-renewing subscriptions, e.g., a one-month subscription("Standard, Pro, and Premium Services"). IF YOU PURCHASE AN AUTOMATICALLY RENEWING SUBSCRIPTION, YOUR SUBSCRIPTION WILL RENEW AT THE END OF THE PERIOD, UNLESS YOU CANCEL FOR YOUR ENDLESS LOVE CURRENT PRICE FOR THESE TYPE OF SUBSCRIPTIONS(STANDARD, PRO, PREMIUM).

    If you want to avoid charges for a new subscription period, you must cancel, as described in the section below, before the end of the then-current subscription period. NOTE: Deleting your account does not cancel your subscription. A notice will be given of changes made in the pricing of the subscription services that you have subscribed and you will be given an opportunity to cancel. If Your Endless Love change the prices of the subscription services and you do not cancel your subscription, you agree that you will be charged at Your Endlesss Love current pricing for subscriptions.

    Cancel Subscription

    If you purchased a subscription directly from Your Endless Love, you may cancel your Payment Method in the payment settings option under your profile. If you purchased through a third party platform such as Apple Store or the Google Play Store, you will need to go into your acount with that Third Party Store and following the instruction to change or cancel your subscriptions. If you cancel your subscription, you may use the subscription period until it expires; however, you agree that no refunds will be given or be entitled to receive them; you will not be eligible for a prorate refund. When you cancel your subscription, your subscription will not be renewed when the period of your current subscription expires and you will no longer be able to use either the "Standard, Pro, or Premium" services or In-App Purchases enabled by your subscription.

    Refunds. Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods.


    If you subscribed using your Apple ID, then all refunds are handled by Apple, not Your Endless Love. You can request a refund of a subscription service by logging onto to the tap and navigate to the settings and tap on "Request subscription refund".


    Pricing

    Your Endless Love may have prices that vary in specific regions based on a number of reasons or factors. Additional taxes may apply based on certain regions or countries that may be in connection to subscription services. "Your Endless Love" company operates a global business, and our pricing varies by a number of factors. We frequently offer promotional rates - which can vary based on region, length of subscription, bundle size and more. We also regularly test new features and payment options.

    Virtual Items

    Perodically, you may purchase a limited, personal, non-transferable, non-sublicensable, revocable licence to access special limited-use features from Your Endless Love, referrred to as "Virtual Items". Note, you are only able to purchase Virtual Items through Your Endless Love or Your Endless Love partners. Virtual Items have a limited license as rightly governed by this Agreement, unless prohibited by applicable law. There are no titles or ownership in or Virtual Items transferred to assigned to you. You agree to not make any sale of a purchased item of any of the Virtual Items. Any Virtual Item balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead shows the extent of your licence to access Virtual Items. Virtual Items do not incur fees for non-use. Your licence in Virtual Items will terminate on the earlier of Your Endless Love ceasing provision of services or your account closing or terminating. Your Endless Love may also at times provide Virtual Items as bonuses to, or parts of, paid subscriptions for its services. Your ability to use Virtual Items you have access to in this manner may terminate at the end of each of your subscription periods and your access to Virtual Items may not “roll over” or accumulate through additional subscription periods. Your access to Virtual Items gained through subscriptions may also end if you cancel your subscription. Your Endless Love, in its sole discretion, reserves the right to charge fees for the right to access or use Virtual Items and/or may distribute Virtual Items with or without charge. Your Endless Love may manage, regulate, control, modify, or eliminate Virtual Items at any time, including taking actions that may impact the perceived value or purchase price, if applicable, of any Virtual Items and Your Endless Love shall have no liability to you for doing so. You shall not sell, redeem, or otherwise transfer Virtual Items to any person or entity. Virtual Items may only be redeemed through our Services. ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH OUR SERVICES ARE FINAL AND NON-REFUNDABLE. YOU ACKNOWLEDGE THAT YOUR ENDLESS LOVE IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

    PUSH NOTIFICATIONS; LOCATION BASED FEATURES

    We may send push notifications regarding in matches, likes, or messages, marketing campaigns(e.g. product offers, events, promotions, or enhancements) you can stop push notifications by doing the following: (i) login into the App, go to Settings, go to Notifications and disable the type of notification you no longer wish to receive to your mobile device. If you wish to opt out of receiving emails from Your Endless Love, you can disable emails in the settings as aforementioned. You will still be able to send emails to us at support@yourEndlessLuv.com as long as your email is valid and it is not subject to bounces or complaints for Your Endless Love services to receive the email directly from you for any inquiries. You can unsubscribe or opt out at any given time in the settings notification area in the App. The "Your Endless Love" App may allow access to or make certain opprutnites for you to view types of content and receive products, services, and/or other materials based on your location. In order to make these opportunites available to you, the App will determine your location using one or more reference points, such as GPS, Bluetooth and/or software withing your mobile device. If you have set your mobile device to disable GPS, Bluetooth or other location determing software or do not authorize the App to access your location data, you will not be able to access location data content, producrs, services, and materials. You can read about more information on how the Your Endless Love app uses and keeps a rentention of your information in the Privacy Policy section.

    Disclaimer

    YOUR ENDLESS LOVE APP AND WEBSITE PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" BASIS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICE (INCLUDING ALL CONTENT CONTAINED THEREIN), INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. YOUR ENDLESS LOVE DOES NOT REPRESENT OR WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR FREE, (B) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED, OR (C) THAT ANY CONTENT OR INFORMATION YOU OBTAIN ON OR THROUGH THE SERVICE WILL BE ACCURATE.


    SHOULD APPLICABLE LAW NOT PERMIT THE FOREGOING EXCLUSION OF EXPRESS OR IMPLIED WARRANTIES, THEN WE GRANT THE MINIMUM EXPRESS OR IMPLIED WARRANTY REQUIRED BY APPLICABLE LAW. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS SECTION.


    YOUR ENDLESS LOVE COMPANY TAKES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANOTHER MEMBER OR THIRD PARTY POSTS, SENDS OR RECEIVES THROUGH THE SERVICE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK.


    Limitation Liability

    TO THE FULLEST EXTENT PERMITTED BY LAW, YOUR ENDLESS LOVE EXPRRESSLY INCLUDES (i) ALL CONDITIONS, REPRESENTATIONS, WARRANTIES AND OTHER TERMS WHICH MAY OTHERWISE BE IMPLIED BY STATUATE, COMMON LAW OR THE LAW OF EQUITY. (ii) ANY LIABILITY INCURRED BY THE ARISING FROM THE USE OF YOUR ENDLESS LOVE, ITS SERVICES OR THESE TERMS AND CONDITONS, INCLUDING WITHOUT LIMITATION OF ANY CLAIMS, CHARGES, DEMANDS, DAMAGES, LIABILITIES, LOSSES, OR EXPENSES OF WHATEVER NATURE AND HOWSOEVER DIRECT, INDIRECT, INCIDENTAL, SPECIAL EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES.


    Any liability incurred by you arising from use of YOUR ENDLESS LOVE App, its services or these terms and conditions, including without limitation for any claims, charges, demands, damages, liabilities, losses or expenses of whatever nature and howsoever direct, indirect, incidental, special, exemplary, punitive or consequential damages (however arising including negligence), loss of use, loss of data, loss caused by a computer or electronic virus, loss of income or profit, loss of or damage to property, wasted management or office time, breach of contract or claims of third parties or other losses of any kind or character, even if YOUR ENDLESS LOVE has been advised of the possibility of such damages or losses, arising out of or in connection with the use of YOUR ENDLESS LOVE. This limitation on liability applies to, but is not limited to, the transmission of any disabling device or virus that may infect your equipment, failure of mechanical or electrical equipment or communication lines, telephone or other interconnect problems (e.g., you cannot access your internet service provider), unauthorised access, theft, bodily injury (other than caused by our negligence), property damage, operator errors, strikes or other labor problems or by natural events in connection with YOUR ENDLESS LOVE including, without limitation, any liability for loss of revenue or income, loss of profits or contracts, loss of business, loss of anticipated savings, loss of goodwill, loss of data, wasted management or office time and any other loss or damage of any kind, however arising and whether caused by tort (including, but not limited to, negligence), breach of contract or otherwise, even if foreseeable whether arising directly or indirectly.


    INDEMNITY BY YOU

    If there is a lawsuit made against Your Endless Love company as a result of your use of Your Endless Love company then we reserve the right to defend or settle the relevant claim as deem fit. All activities you make and information you post on Your Endless Love remain your sole responsibilty. Therefore, you agree to indemnify, defend, release, and hold us, and our partners, licensors, affiliates, contracts, officers, directors, employees, representatives and agents, harmless, from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with:

    1. any negligent acts, omissions or wilful misconduct by you;
    2. your access to and use of the App;
    3. the uploading or submission of Content to the App by you;
    4. any breach of these Terms by you; and/or
    5. your violation of any law or of any rights of any third party.

    We retain the exclusive right to settle, compromise and pay any and all claims or causes of action which are brought against us without your prior consent. If we ask, you will co-operate fully and reasonably as required by us in the defence of any relevant claim. The foregoing provision does not require you to indemnify Your Endless Love company for any unconscionable commercial practice or any fraud, deception, false promise, misrepresentation or concealment, suppression or omission of any material fact in connection with the App.

    THIRD PARTY APP STORE

    The following terms and conditions apply to you if you download the App from a Third Party Store. As the other terms and conditions may be less restrictive than, or otherwise conflict with, the terms and coniditions of "Your Endless Love" Terms and Conditions, the more restrictive or conflicitng terms and conditions in this Secton will apply, but solely with respect to the App and the Third Party Store. You acknowledge and agree to the following:

    1. These terms are conclusive between you and the Your Endless Love Company and not with the providers of the Third Party Store, and Your Endless Love Company(and not the Third Party providers) is solely responsible for the App and the content thereof. The terms and conditions rules for the App may be less restrictive or in conflict with the applicable terms of service of the Third Party Store from which you obtain the App, the more restricitve of conflicting terms of the Third Party Store will take precedence and will apply.
    2. The Third Party Store provider is not obligated whatsoever to provide maintenance and support services of Your Endless Love App. Your Endless Love company is solely responsible for any product warranties, wether express or implied by law, to the extent not effectively disclaimed. The Third Party Storer provider will have no warrant obligation whatsoever of the Your Endless App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Your Endless Love Company.
    3. Your Endless Love Company, not the Third Party Store provider, is responsible for addressing any claims you or third party may have relating to the App or the possession and/or use of the App. Inclusive thereof, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; (iii) claims arising under consumer protection or similar leglislation; and/or (iv) intellectual property infringement claims.
    4. The Third Party Store provider and its subsidiaries are third pary beneficiaries of these Terms, nd, upon your acceptance of these Terms, the Third Party Store provider from whom you obtained the App will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

    If there is an incidental event between a Third Party Store's or mobile carrier's applicable terms and conditions and "Your Endless Love" terms in this section, the terms and conditons of the Third Party Store or mobile carrier shall govern and control. We are not responsible and have no liability whatsoever for third-party goods or service you obtain through a Third Party Store or mobile carrrier. We encourage you to make whatever investigation you deem as neccessary or take appropriate action before proceeding with any online transaction with any Third Party merchant.

    MISCELLEANOUS

    Your Endless Love Terms and Conditions may change from to time, so please read our terms every so often to keep yourself updated. The terms is an agreement you adhere to, which is between you and the Your Endless Love Company. The terms replace all previous agreements, representations and arrangements between us(documented or verbally), excluding the Privacy Policy. Nothing in terms in this clause shall limit or exclude any liability for fraudelent misrepresentation.
    Your Endless Love Company has made reasonable steps to ensure the currency, availability, correctness and completeness of the information contrained on Your Endless Love and provides that information on "as is", "as available" basis. Your Endless Love does not give or make any warrant or representation of any kind about the information contrained on Your Endless Lov, whether express or implied. Use of Your Endless Love and the materials available on it is at your sole risk. Your Endless Love is not responsible for any loss arising from the transmission, use of data, or inaccurate Content posted by users. Your are responsible for taking all necessary precautions to ensure that any material you may obtain from Your Endless Love does not have any viruses, or other hamful software. You accept Your Endless Love will not be provided uniterupted or error free, that defects may not be correct or that Your Endless Love, or the server that makes it available, are free of viruses or bugs, spyware, Trojan horses or any similar malicous software.
    Your Endless Love is not responsible for any damages to your computer hardware, computer software, or other equipment or technology including, but without limitation damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure or any other technical or other malfunction. The communications between you and Your Endless Love Company may occur electronically if you use the App or send emails via Your Endless Domain, or Your Endless Love posts notices in the App or send communication via email to you. Contractually, you agree that all terms and conditions, agreements, notices, disclosures, and other communications that Your Endless Love Company provides to you electronically satisfy if it were to be in writing. The foregoing does not affect your statutory rights, including but not limited to the Electronic Signatures in Global and National Commerce Act at 15 U.S.C. Sec. 7001 et. seq.

    Legal

    If for any reason, the Terms are declared illegal, invalid, or otherwise unenforceable by a court of a competent jurisdiction, then to the exent that term is illegal, invalid or unenforceable, then it shall be severed and deleted from the Terms and the remainder of the Terms will conserved, remain in force and effect and continue to be enforceable. No failure or delay in exercising any right, power or privilege under the Terms shall operate as a waiver of such right or acceptance of any variation of the Terms and nor shall any single or partial exercise by either party of any right, power or privilege preclude any further exercise of the right or the exercise of any other right, power or privilege.

    You represent and warrant that:

    1. You are not located in a country this is subject to a U.S. Government embargo, or that has been designated by the U.S Government as a "terrorist supporting" country; and
    2. You are not listed on any U.S Government list of prohibited or restricted parties.
    3. You are located in a country that is subject to the Bahamian Government or rules and laws oblige under the Commonwealh of England.

    Global App

    By using Your Endless Love App, you agree and acknowledge that Your Endless Love is a global app that operates on servers located in various countries worldwide, including the United States. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as in your home country or residence. When you post personal information by choosing this App("Your Endless Love"), you giving consent to transfer your personal data as well, and storage and processing of your personal information in, any of the countries or regions.

    The Your Endless Love App may contain links to third-party websites or resources. In these cases, you are giving consent and in acceptance that we are not responsible or be held liable for the following:

    1. the availability or accuract of such websites or resources; or
    2. the content, products, or services on or available from third party websites or resources.

    Third party links to websires or resources do not imply any endorsement. By using the Your Endless Love App, you acknowledge sole responsibility for and you make the assumption of all risks involved from the usage of websites or resources. Framing, in-line linking or other methods of association with the Your Endless Love App, you are expressly prohibited without first obtaining our approval that is documented and branded by Your Endless Love Company. The terms and conditions of Your Endless Love and rights and licences granted hereunder, shall not be transferred or assigned by you. However, you will not be assigned by the company(Your Endless Love) without restriction. In any event, if there is discrpance between the English language version and any translated copies of the Terms, the English version shall prevail.

    YOUR ENDLESS LOVE COMPANY
